1. Introduction

Welcome to Petit Niche.

These Terms & Conditions apply to purchases made through our online store and govern the contractual relationship between Petit Niche and its customers.

Mandatory consumer protection laws applicable to your purchase remain unaffected by these Terms.

3. Independent Fragrance Retailer

Petit Niche independently sources and decants authentic fragrances into smaller spray bottles.

Unless explicitly stated otherwise, our 5 ml and 10 ml products are independently prepared decants and are not supplied in the original manufacturer's retail packaging.

Petit Niche is not affiliated with, endorsed by, sponsored by or an authorised retailer of the original fragrance manufacturers, unless expressly stated otherwise.

Brand names and trademarks remain the property of their respective owners and are used to identify the original fragrances.

4. Products and Descriptions

We endeavour to provide accurate product descriptions, images, quantities and relevant product information.

Our decants are independently prepared from authentic original fragrances.

Any differences between our decant packaging and the original manufacturer's retail packaging will be clearly communicated.

Product availability may change.

Nothing in this section limits your statutory rights if a product does not conform to the purchase agreement.

5. Prices and Taxes

Product prices are displayed in the selected currency.

For EU consumer purchases, applicable VAT is included in the displayed consumer prices.

Shipping charges and other applicable costs will be clearly presented before checkout.

For destinations outside the EU, import duties, taxes and customs charges may apply. Their allocation will be communicated before purchase.

6. Orders and Payment

By placing an order, you submit a request to purchase the selected products.

The purchase agreement is concluded when we accept your order and confirm the agreement.

Available payment methods are displayed during checkout.

If an order cannot be fulfilled, we will contact you and provide an appropriate refund where payment has already been received.

We may decline orders for legitimate reasons, subject to applicable consumer protection laws.

7. Shipping and Delivery

Orders are prepared and dispatched in accordance with our Shipping Policy.

Delivery destinations are subject to product availability, transport regulations and carrier restrictions.

We remain responsible for delivery in accordance with applicable consumer protection legislation.

If delivery cannot take place within the agreed timeframe, your statutory rights remain unaffected.

8. Right of Withdrawal

Eligible consumers have the statutory right to withdraw from a distance purchase within the applicable withdrawal period.

Petit Niche additionally offers a voluntary 30-day return period for eligible products.

Detailed conditions, return procedures and refund arrangements are described in our Return & Refund Policy.

Our decants are delivered with a hygiene seal. In accordance with Article 6:230p(f) of the Dutch Civil Code, the right of withdrawal does not apply to a sealed decant once its seal has been broken after delivery, as it is then no longer suitable for return for reasons of health protection or hygiene. Decants with an intact seal can be returned within the withdrawal period. This does not affect your rights if a product is damaged, defective or incorrect.

Any statutory exceptions to the right of withdrawal will apply only where the relevant legal requirements are satisfied and customers have received the required information.

9. Product Conformity and Statutory Rights

Petit Niche is committed to supplying products that conform to the purchase agreement and applicable legal requirements.

If a product is defective, damaged or does not conform to the agreement, you are entitled to the remedies provided by applicable consumer law.

Nothing in these Terms excludes or restricts mandatory statutory guarantees or consumer rights.

10. Product Information and Responsible Use

Fragrance products should be used in accordance with their applicable product information and safety warnings.

Customers should review relevant ingredients and warnings before use, particularly where they are aware of sensitivities to fragrance ingredients.

This section does not exclude or limit any legal responsibility of Petit Niche.

11. Intellectual Property

The Petit Niche name, logo, original website content and other materials owned by Petit Niche are protected by applicable intellectual property laws.

Third-party trademarks, product names and brand identities remain the property of their respective owners.

Unauthorised commercial reproduction of protected materials is prohibited, subject to applicable legal exceptions.

12. Website Availability

We endeavour to maintain accurate and accessible website services.

Temporary interruptions, maintenance or technical difficulties may occur.

Nothing in this section limits any rights or remedies available under applicable law.

13. Liability

Petit Niche is responsible for its obligations under the purchase agreement and applicable legislation.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable product liability rules and mandatory consumer protection rights.

Any limitation of liability applies only to the extent legally permitted.

14. Force Majeure

Where circumstances beyond our reasonable control affect our ability to fulfil an order, we will inform affected customers where appropriate.

Any consequences will be handled in accordance with applicable law.

This provision does not exclude statutory cancellation, refund or delivery rights.

15. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data protection legislation.

We aim to resolve complaints fairly and within a reasonable timeframe.

Where applicable, consumers may also seek assistance through competent consumer protection organisations or alternative dispute resolution bodies.

17. Applicable Law

These Terms are governed by Dutch law.

This choice of law does not deprive consumers of mandatory protections available under the law of their country of habitual residence where applicable.

18. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to an accepted order will not be retrospectively changed to the customer's disadvantage without a valid legal basis.
